Ms SK is a single mother who inherited her late father’s house about two years ago. She needed R60 000 to replace the windows in the house. The work had to be done urgently, because the security risk was a concern.

Ms SK had investigated taking out a individual loan from the lender, but she was put off by the unaffordable instalments and the attention rate of 31 percent.

“I told [the revenue consultant] that I definitely cannot afford that. Her response was: ‘But you can pay it back when your house loan is approved.’”

After processing the program for the individual loan from the lender and the rotating credit score service, the advisor helped Ms SK to apply for the property loan.

The individual loan from the lender of R60 000 was paid to her the following day, but on Jan 13 this year, Ms SK was informed that her program for a house loan had been dropped, “due to budget constraints”.

Fortunately, Ms SK never touched the R60 000 in her account, although her overdraft service consumed a small portion of it. Ms SK paid back the R60 000 to FNB on Jan 27.

But FNB is demanding that Ms SK pay a “settlement amount” of R4 919 for “accrued fees, charges and interest”. The bank says this amount is valid until today, and that the fees, charges and attention “will continue to accrue until the loan has been repaid in full and closed off”.

The charges and fees (an initiation fee of R1 140, a monthly account fee of R57 and credit score life insurance of R177) amount to R1 374. The remaining R3 545 is attention. The first settlement amount that FNB gave Ms SK was R4 028, but this increased to R4 919 in one week.

Ms SK says this is unfair and that the lender shouldn’t be holding her liable for any attention.

In early Jan, when Ms SK phoned FNB’s home mortgages division to check on the progress of her program, she discovered that it had not been received.

“That was five weeks after the program was made. Had it been sent from the branch to the home mortgages division promptly, my program would have been dropped sooner – and then I wouldn’t be liable for so much attention on a individual loan from the lender payout that was lying in my account for seven weeks,” she says.

Ms SK has lodged a complaint about poor service and bad advice with the Ombudsman for Banking Services.

Ms SK also believes that she is a victim of careless lending, and has lodged a complaint with the Nationwide Credit Regulator.

When requested to explain the discrepancy between the costs declared in Ms SK’s quotation for a individual loan from the lender, on one hand, and the earnings and expenditure statement in her mortgage program for the loan, on the other, Du Toit says: “The individual loan from the lender contract costs exclude the repayment obligations that are pulled directly from the money score agency as debt repayments and systematically added to the cost of living, to assess the budget.

Explaining FNB’s decision to decline the property loan, Du Toit says that, according to the information on the mortgage program for the loan, Ms SK earns an average net monthly earnings of R20 568 and has costs of R16 104.
