Ms SK is a single mother who inherited her late father’s house about two years ago. She needed R60 000 to replace the windows in the house. The work had to be done urgently, because the security risk was a concern.

Ms SK had investigated taking out a individual loan from the lender, but she was put off by the unaffordable instalments and the attention rate of 31 percent.

So, armed with her deed of sale and the other documents required to apply for a house loan, she went to the N1 City branch of First Nationwide Financial institution (FNB) in Cape Town on December 2 last year and met with a revenue advisor. Ms SK says the advisor advised her that, because it typically takes three months for a mortgage bond to be registered, she should take out a individual loan from the lender in addition to a house loan.

The individual loan from the lender would be granted almost instantly, with the first repayment due in late February only, which would be more or less when the mortgage bond would be registered. Ms SK agreed to the individual loan from the lender, but says she was emphatic that she could not afford repayments of almost R2 700 a month on the loan.

“I told [the revenue consultant] that I definitely cannot afford that. Her response was: ‘But you can pay it back when your house loan is approved.’”

After processing the program for the individual loan from the lender and the rotating credit score service, the advisor helped Ms SK to apply for the property loan.

The individual loan from the lender of R60 000 was paid to her the following day, but on Jan 13 this year, Ms SK was informed that her program for a house loan had been dropped, “due to budget constraints”.

Fortunately, Ms SK never touched the R60 000 in her account, although her overdraft service consumed a small portion of it. Ms SK paid back the R60 000 to FNB on Jan 27.

But FNB is demanding that Ms SK pay a “settlement amount” of R4 919 for “accrued fees, charges and interest”. The bank says this amount is valid until today, and that the fees, charges and attention “will continue to accrue until the loan has been repaid in full and closed off”.

The charges and fees (an initiation fee of R1 140, a monthly account fee of R57 and credit score life insurance of R177) amount to R1 374. The remaining R3 545 is attention. The first settlement amount that FNB gave Ms SK was R4 028, but this increased to R4 919 in one week.

Ms SK says this is unfair and that the lender shouldn’t be holding her liable for any attention.

In early Jan, when Ms SK phoned FNB’s home mortgages division to check on the progress of her program, she discovered that it had not been received.

“That was five weeks after the program was made. Had it been sent from the branch to the home mortgages division promptly, my program would have been dropped sooner – and then I wouldn’t be liable for so much attention on a individual loan from the lender payout that was lying in my account for seven weeks,” she says.

Ms SK has lodged a complaint about poor service and bad advice with the Ombudsman for Banking Services.

Ms SK also believes that she is a victim of careless lending, and has lodged a complaint with the Nationwide Credit Regulator.

In terms of the Nationwide Credit Act, if a credit score company fails to conduct an budget assessment before advancing credit score to you, the company could be guilty of entering into a careless credit score agreement.

“I don’t know how she arrived at R6 000 costs. My costs are around R13 000 before food.”

However, Ms SK’s initials are on the individual loan from the lender quotation.

Ms SK says she cannot recall the advisor questioning her about her monthly costs and she was not requested for bank statements when the advisor processed either the individual loan from the lender or the mortgage program for the loan.

An allegation of careless lending will fail if the money score company discovers that you were not entirely truthful in answering questions put to you by the money score company when you applied for credit score. This is problematic, because if a credit score company induces you to be untruthful – by understating your costs – and you agree to this, you lose the right to bring a charge of careless lending against the company.

FNB DENIES GRANTING CREDIT RECKLESSLY

Pieter du Toit, chief executive of loans at First Nationwide Financial institution (FNB), says: “The bank denies the customer’s claims and, in particular, the allegation that credit score was granted recklessly. FNB subscribes to the requirements of the Nationwide Credit Act and [our] internal credit score policies ensure compliance to [the] same.”

When requested to explain the discrepancy between the costs declared in Ms SK’s quotation for a individual loan from the lender, on one hand, and the earnings and expenditure statement in her mortgage program for the loan, on the other, Du Toit says: “The individual loan from the lender contract costs exclude the repayment obligations that are pulled directly from the money score agency as debt repayments and systematically added to the cost of living, to assess the budget.

“The mortgage program for the loan form contains an earnings and expense declaration that includes any debt repayment obligations.”
Explaining FNB’s decision to decline the property loan, Du Toit says that, according to the information on the mortgage program for the loan, Ms SK earns an average net monthly earnings of R20 568 and has costs of R16 104. The individual loan from the lender and rotating loan instalments amount to R2 675 and R892 respectively, which indicates that, “by her own declaration”, the client “would be able to afford” these instalments and have surplus disposable earnings.

“Considering these figures, it becomes clear that the client would not have been able to afford all three products (personal loan, rotating loan and house loan). The client took up the individual loan from the lender and rotating loan offers, and, when the mortgage program for the loan was processed in Jan 2014, the additional debt resulted in the mortgage program for the loan being dropped,” he says.

Considering that some revenue professionals have to meet revenue targets, Personal Finance requested how FNB remunerates its professionals.

Du Toit says: “The influence of remuneration principles would not have had any influence on the outcome. It is the bank’s considered view that remuneration or revenue target considerations have no bearing on the complaint.”

When requested how the same advisor could submit three programs for credit score by the same client on the same day and the total of all the money score applied for could far exceed the customer’s budget, Du Toit replied: “Even though three programs were submitted, only two programs were granted. Sales professionals are not in a position to assess credit score programs and are required to capture the information provided by a client as accurately as possible.”
